Privacy Policy of PleadingPower LLC (PleadingPower). When you access our website or the application we collect certain internet or other electronic network activity information via a variety of technologies, as described in this Policy.

By accessing or using PleadingPower (whether it be the “application”, “platform”, “services”, or the “website”), you indicate to us that you consent to this privacy policy and any amendments thereto. If you do not agree with the terms of this Privacy Policy, please do not use PleadingPower or any services available through PleadingPower.

Not applicable to third-party sites. Please note that this Privacy Policy applies to Personal Information collected through our platform. This Privacy Policy does not apply to third-party services, websites, or applications that we may link to through the website. Should you decide to use one of these links to leave our website, we encourage you to review the privacy policies that apply to the services, websites, or applications you choose to access.

Personal Information (or Data). When we use the term “Personal Information,” we mean any information that directly, indirectly, or in connection with other information—including a personal identification number—allows for the identification or identifiability of a natural person. This includes information you provide to us when you register to use our Website, subscribe to our Services, participate in any discussion boards, forums or other social media functions on our site, attend a PleadingPower event, or report a problem with our Site or Services. We collect personal information about you when you voluntarily submit information directly to us by filling in forms on our Site or by corresponding with us by phone, e-mail, or other means. In order to access and use certain areas and services of the Site, PleadingPower may ask you for Personal Information, including your name, address, e-mail address, and telephone number, as well as commercial information, such as your business name, address, and telephone number. You can decline to provide certain information to us, but you may be unable to access certain services and features offered through the Site, and we may be unable to respond to you. By submitting a form on the Site, you consent to our providing your Personal Information to third parties as we determine is necessary in order to process your submission and improve the accuracy of forms submitted on the Site. We may also receive personal information about you from individuals or corporate entities which are subscribers to the Services where you are to be designated a user of the Services.

Usage Data. Information is collected automatically through this Application (or third-party services employed in this Application). This can include: the IP addresses or domain names of the computers utilized by the users who use this Application, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by the user, the various time details per visit(e.g., the time spent on each page within the Application) and the details about the path followed within the Application with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the User’s IT environment.

Cookie policy. This Application uses Trackers. A cookie is a series of data characters that is placed by the web server into the browser's application folder on your computer. Once placed onto your machine, the cookie will allow the Site to “recall” you as a unique individual. The Site uses cookies to personalize information for certain segments of its customer base. In some instances, cookies are also used to associate individual customers with their information profiles where users have elected to create such a profile. Should you choose to do so, cookies can be removed from your hard drive and certain web browsers can be set so that cookies are not used or saved. Do Not Track Signals from Web Browsers. PleadingPower is not configured to support Do Not Track (“DNT”) signals from web browsers.

Litigation Data You Provide In Connection with the Services. PleadingPower adheres to the strictest protocols in connection with the data you provide to PleadingPower in the course of using the Services. Information provided to PleadingPower via the Services is stored in our third-party cloud storage provider, which adheres to the strictest security requirements in the industry. PleadingPower may access this data in order to deliver and improve the Services, to test features in development, conduct audits, and troubleshoot.

The categories of personal information we collect. PleadingPower’s web server uses an extended log file format which captures the following information for all users of the Site: date and time of visit, referring address (location from which a visitor comes to the Site), type of Internet browser, and visitor’s IP address. (Each computer that connects to the Internet is assigned a unique number, an IP address, for identification purposes). In addition, internet information, personal data such as name, e-mail address, other identifiable personal data, and usage data are also collected.

How we use the information we collect. We may disclose the personal information we collect about you to a third party for business purposes. In this case, we enter a written agreement with such a third party that requires the recipient to both keep the personal information confidential and not use it for any purpose other than those necessary for the performance of the agreement. We may also disclose your personal information to third parties when you explicitly ask or authorize us to do so, in order to provide you with our Service.

No sale of your personal information. Simply stated, PleadingPower does not sell your personal information.

Security. PleadingPower has strict security measures in place to protect customer information. Unfortunately, no data transmission over the Internet can be guaranteed to be secure. As a result, while we employ strict security measures to protect data, we cannot guarantee the security of any information transmitted to PleadingPower and are not responsible for the actions of any third parties that may receive any such information. Password-protected areas of the Site can be accessed only with a valid password. Each password owner is responsible for keeping the password confidential and safe.

What are the purposes for which we use your personal information? We may use your personal information to allow the operational function of this Application and features thereof (“business purposes”). In such cases, your personal information will be processed in a fashion necessary and proportionate to the business purpose for which it was collected and strictly within the limits of compatible operational purposes. We may also use your personal information for complying with the law and defending our rights before the competent authorities where our rights and interests are threatened or we suffer an actual damage. We will not use your personal information for different, unrelated, or incompatible purposes without notifying you.

Data Subject Rights. Depending on your residency, you may have certain data subject rights. These rights vary by state and country, but they may include the right to: (i) request additional disclosures about the Personal Information we collect, use, and disclose, i.e., a “Request to Know (Categories of Information)”; (ii) obtain a copy of Personal Information, i.e., a “Request to Know (Specific Pieces of Information),” sometimes called the Right to Access; (iii) request deletion of Personal Information, i.e., a “Request to Delete Information,” sometimes called the Right to Be Forgotten; (iii) opt out of the sale of Personal Information if we were to sell Personal Information, i.e., a “Request to Opt Out.” We do not sell your information, so you are already opted-out of such sales. We will not discriminate against you for exercising any of these rights. However, we may not be able to provide the same quality of goods or services to you if we do not have the necessary data available. If you wish to exercise any of these rights please e-mail info@pleadingpower.com with the phrase “Data Subject Rights” in the subject line. We will review your requests and respond accordingly. The rights described herein are not absolute and we reserve all of our rights available to us at law in this regard. Additionally, if we retain your Personal Information only in de-identified form, we will not attempt to re-identify your data in response to a Data Subject Rights request. If you make a request related to Personal Information about you, we will need to verify your identity. To do so, we will request that you match specific pieces of information you have provided us previously, as well as, in some instances, provide a signed declaration under penalty of perjury that you are the individual whose personal information is the subject of the request. If it is necessary to collect additional information from you, we will use the information only for verification purposes and will delete it as soon as practicable after complying the request. For requests related to particularly sensitive information, we may require additional proof of identification. If you make a Data Subject Rights request through an authorized agent, we will require written proof that the agent is authorized to act on your behalf. We will process your request within the time provided by applicable law.

Minors. If you are under 18 years old, you may not use PleadingPower or the Services. We do not knowingly allow any users under the age of eighteen to use or otherwise access . We do not seek any personal information (or any information at all) from any persons under 18 years old. Because we do not intentionally collect any information from children under the age of 18, we also do not knowingly share or disclose such information to third parties. If you have reason to believe that a child under 18 years of age has provided us with information, please contact us at info@pleadingpower.com.

LEGAL DISCLAIMER. The Site operates "AS-IS" and "AS-AVAILABLE," without warranties of any other kind. We are not responsible for events beyond our direct control. This Privacy Policy is governed by the laws of the State of Florida, excluding conflicts of law principles. Any legal actions against us arising out of or related to the Site or any services offered or provided therefrom must be commenced in the State of Florida in the United States of America.

Changes to the Privacy Policy.  PleadingPower reserves the right to amend this Privacy Policy at any time with or without notice. Any changes will be posted on this page.  PleadingPower encourages you to check this page regularly. If you provide information to us, access, or use the Sites in any way after this Privacy Policy has been changed, you will be deemed to have unconditionally consented and agreed to such changes. The most current version of this Privacy Policy will be available on the web page at all appropriate times and will supersede all previous versions of this Privacy Policy.

The right to request the deletion of your personal information. You have the right to request that we delete any of your personal information, subject to exceptions set forth by the law (such as, including but not limited to, where the information is used to identify and repair errors on this Application, to detect security incidents and protect against fraudulent or illegal activities, to exercise certain rights etc.).If no legal exception applies, as a result of exercising your right, we will delete your personal information and direct any of our service providers to do so.

How to exercise your rights. To exercise the rights described above, you need to submit your verifiable request to us by contacting us via the details provided in this document. For us to respond to your request, it’s necessary that we know who you are. Therefore, you can only exercise the above rights by making a verifiable request which must: provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will not respond to any request if we are unable to verify your identity and therefore confirm the personal information in our possession actually relates to you.

How and when we are expected to handle your request. We will confirm receipt of your verifiable request within 15 days and provide information about how we will process your request. We will respond to your request within 45 days of its receipt. Should we need more time, we will explain to youth reasons why and how much more time we need. In this regard, please note that we may take up to 90 days to fulfill your request. Our disclosures will cover the preceding 12-month period. Should we deny your request, we will explain to you the reasons behind our denial. We do not charge a fee to process or respond to your verifiable request unless such request is manifestly unfounded or excessive. In such cases, we may charge a reasonable fee or refuse to act on the request. In either case, we will communicate our choices and explain the reasons behind them.  User: The individual using this Application who, unless otherwise specified, coincides with the Data Subject.

Mode and Place of Processing the Data. Computers used to access PleadingPower websites automatically transmit certain non-personally identifiable information when you visit our sites, such as the type of browser you are using or the domain name of your internet service provider. They also collect aggregate information on the site pages our users visit. PleadingPower’s ability to limit collection of this data is limited, as it cannot control, for example, whether an individual user’s non-personally identifiable information is gathered by Google Analytics or a similar service. Thus, the user is responsible for the user’s own settings on any computer used to access PleadingPower’s websites, and the user is thus responsible for determining whether information is transmitted from its device to PleadingPower through any means. Computer data containing no personally identifiable information will be used only for internal business purposes. PleadingPower takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data. The data processing is carried out using computers and/or IT-enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to PleadingPower, in some cases, the data may be accessible to certain types of persons in charge, involved with the operation of this Application(administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers ,hosting providers, IT companies, communications agencies) appointed, if necessary, as data processors.

Legal Basis of Processing. PleadingPower may process personal data relating to users if one of the following applies: Users have given their consent for one or more specific purposes. Provision of data is necessary for the performance of a service. Processing is necessary for compliance with a legal obligation to which PleadingPower is subject. Processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in PleadingPower.

Place. The data is processed at PleadingPower’s operating offices and in any other places where the parties involved in the processing are located.

Retention Time. Personal Data shall be processed and stored for as long as required by the purpose they have been collected for. Therefore, Personal data collected for purposes related to the performance of a contract between PleadingPower and the User shall be retained until such contract has been fully performed. After the services have been rendered, PleadingPower will have 6 months to delete all the identifiable personal data of the user. In case there is no express agreement, data will be stored for a maximum of 1 year. PleadingPower may be allowed to retain personal data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, PleadingPower may be obliged to retain personal data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority. Once the retention period expires, personal data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification, and the right to data portability cannot be enforced after the expiration of the retention period.

The rights of Users. Users may exercise certain rights regarding their Data processed by PleadingPower. In particular, users have the right to: (1) Withdraw their consent at anytime. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data. (2) Object to processing of their Data. Users have the right to object to the processing of their Data if the processing is carried out on a legal basis other than consent. Further details are provided in the dedicated section below. (3) Access their Data. Users have the right to learn if Data is being processed by PleadingPower, obtain disclosure regarding certain aspects of the processing, and obtain a copy of the Data undergoing processing. (4) Verify and seek rectification. Users have the right to verify the accuracy of their Data and ask for it to be updated or corrected. (5) Restrict the processing of their Data. Users have the right, under certain circumstances, to restrict the processing of their Data. In this case, PleadingPower will not process their Data for any purpose other than storing it. (6) Have their Personal Data deleted or otherwise removed. Users have the right, under certain circumstances, to obtain the erasure of their Data from PleadingPower.

Unless required by law to do so, PleadingPower will not share, or otherwise disclose any of the information it collects online without your permission except for internal business purposes.

How to exercise these rights. Any requests to exercise user rights can be directed to PleadingPower through the contact details provided in this document. These requests can be exercised free of charge and will be addressed by PleadingPower as early as possible and always within one month.

Changes to this privacy policy. PleadingPower reserves the right to make changes to this privacy policy at any time by notifying its users on this page and possibly within this Application and/or—as far as technically and legally feasible—sending a notice to users via any contact information available to the Owner.

Applicable Law. The services of PleadingPower are intended for the use of U.S. residents. To the extent U.S.-based residents of states other than Florida access PleadingPower’s websites, the laws of the State of Florida shall govern on all matters related to the collection of data and privacy of collected information. If you access the websites from outside the State of Florida, you consent to this provision. To the extent users of PleadingPower’s websites are not based in the United States, PleadingPower explicitly disclaims liability for compliance with the user’s local laws related to data collection and online privacy. Non-U.S. users should not access the websites. To the extent a non-U.S.-based user proceeds to use the websites despite this warning, only this policy shall apply.
